Circular on verification of MSPO Logo usage by Certificate Holders
This circular is intended to provide further clarification on the verification of the MSPO Logo usage by the Certificate Holders during MSPO Certification Audits by all the Accredited Certification Bodies (ACBs) and Non-Accredited Certification Bodies (CBs). The additional requirements stipulated in this circular shall be applied referring to the existing MSPO Scheme requirements as follows:
1. MSPO Certification System Document (MSPOCS01) dated 1 October 2019
“3.6 (iv)The ACB is responsible for the following: Verifying the use of the certificates for oil palm management and/or supply chain, and the use of the MSPO logo;” and
2. Issuance of MSPO Logo Usage License by MPOCC under the Malaysian Sustainable Palm Oil (MSPO) Certification Scheme (MSPOLGP04) dated 1 October 2019
“7. Role of ACB: ACBs are required to report unapproved and/or non-conforming uses against the requirements in this document of the MSPO Logo and its Trademark to MPOCC and to include the unapproved and/or non-conforming uses against the requirements in this document of the MSPO Logo in the audit report / audit summary report.”
Additional requirements:
All ACBs and CBs shall implement the following requirements during MSPO Certification Audits:
a. Shall raise Major Nonconformity if found unapproved and/or non-conforming uses against the requirements of the MSPO Logo and its Trademark by the Certificate Holders; and
b. Shall report unapproved and/or non-conforming uses against the requirements of the MSPO Logo and its Trademark to MPOCC within 7 working days. MPOCC will evaluate the unapproved and/or non-conforming uses of the MSPO Logo to determine whether further action, including legal action, is required.
NOTE 1: The MSPO Logo is copyright material and a Trademark™ registered by MPOCC. The use of MSPO Logo and related MSPO claims in Malaysia and globally is regulated and governed by MPOCC. Unauthorized use of this copyright material is prohibited and may lead to legal action.
Note 2: ACBs and CBs shall report the unapproved and/or non-conforming MSPO Logo and its Trademark to Certification Scheme Unit Manager, Mr. Haris, at haris@mpocc.org.my of MPOCC.
